These Terms & Conditions ("Terms") govern your access to and use of the PuffCounter mobile application (the "App"), developed by AnyDev ("we", "us", or "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
PuffCounter is a self-tracking and motivation tool that helps you monitor and gradually reduce your vaping or smoking through logged data, quit plans, statistics, and an AI coach. The App is not a medical device and does not provide medical advice, diagnosis, or treatment. Nicotine addiction is a health matter: always consult a qualified healthcare professional about quitting strategies, nicotine replacement therapies, or any symptoms you experience. Never disregard professional medical advice because of something the App or its AI coach displayed.
The App deals with nicotine consumption and is intended exclusively for users who are 18 years of age or older (or the age of majority in your jurisdiction, if higher). By using the App you confirm that you meet this requirement.
You sign in with your Google or Apple account. You are responsible for maintaining the security of the device and credentials you use to access the App, and for all activity that occurs under your account. You may delete your account at any time from Profile → Delete account, which permanently removes your data as described in our Privacy Policy.

The App's assistant uses artificial intelligence to interpret your messages and suggest actions such as logging consumption or adjusting your plan. AI-generated content can be inaccurate, incomplete, or inappropriate for your specific situation. It is provided for motivation and convenience only, and Section 1 applies fully to everything it says. You remain responsible for reviewing any action the assistant proposes before confirming it.

The App, including its design, code, branding, and content (excluding the data you log), is owned by us or our licensors and is protected by intellectual property laws. These Terms give you a limited, personal, non-exclusive, non-transferable right to use the App on your devices; they transfer no ownership. Your use of the App is also subject to the End User License Agreement (EULA).
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of statistics or AI responses, or uninterrupted availability. We do not warrant that using the App will result in reduced consumption or successful cessation.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, health outcomes, or profits, arising from your use of or inability to use the App. Our total aggregate liability for any claim related to the App shall not exceed the amount you paid us in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms. Sections that by their nature should survive termination (including 7, 8, and 9) will survive.
We may update these Terms from time to time. Material changes will be reflected in the "last updated" date at the top of this page and, where appropriate, announced in the App. Continued use of the App after a change means you accept the updated Terms.
These Terms are governed by the laws of Spain, without prejudice to any mandatory consumer protections of the country in which you reside.
