These Terms & Conditions ("Terms") govern your use of Booktime, an audiobook streaming application developed by AnyDev ("we", "us", or "our"). By creating an account or using the Booktime mobile application (the "App"), you agree to these Terms. If you do not agree, do not use the App.
Booktime gives you access to a catalogue of audiobooks for streaming on your mobile device. Access to the full catalogue requires a paid subscription; some content may be available without one. We license the audiobooks we offer from rights holders, and the catalogue may change over time as those licences begin and end.
You must be at least 13 years old, or the minimum age required in your country to consent to the processing of your personal data, whichever is higher. If you are under the age of majority where you live, you may only use the App with the involvement of a parent or guardian who accepts these Terms.
You sign in with Google, with Apple, or with an email address and password. You are responsible for keeping your credentials confidential and for everything that happens under your account. Accounts are personal: do not share them, and do not let other people use yours. Notify us promptly if you believe your account has been compromised.
Premium access is sold as an auto-renewing subscription, billed through the Apple App Store or Google Play. Prices, billing periods, renewal, and cancellation are covered in detail in our Subscription Terms, which form part of these Terms.
In short: subscriptions renew automatically until you cancel, cancellation is done through the store that sold you the subscription, and refunds are governed by that store's policy — not by us.
Your subscription buys you access, not ownership. While your subscription is active, we grant you a limited, personal, non-exclusive, non-transferable right to stream the audiobooks in the catalogue for your own private, non-commercial listening.
You may not:
Access ends when your subscription ends. Titles may also leave the catalogue when a licence expires, and we are not obliged to keep any particular title available.
Bookmarks, notes, ratings, and review comments are content you provide. You keep ownership of it, and you grant us a worldwide, royalty-free licence to store, display, and use it for the purpose of operating the App — which, for ratings and comments, includes showing them publicly alongside the relevant audiobook.
You are responsible for what you submit. Do not post anything unlawful, defamatory, hateful, harassing, deceptive, or infringing of someone else's rights. We may remove content that breaches these Terms.
Ratings are final. The App deliberately offers no way to edit or delete a review once it has been submitted. Consider what you write before sending it.
Do not misuse the service. In particular, do not attempt to gain unauthorised access to our systems or another user's account, probe or test our infrastructure without permission, interfere with the App's normal operation, submit false or automated ratings, or use the App in violation of any applicable law.
The App — its software, design, trademarks, and branding — belongs to us and our licensors. The audiobooks, cover art, and accompanying text belong to their respective rights holders. Nothing in these Terms transfers any of those rights to you. If you believe content in Booktime infringes your copyright, see our Content & Copyright Policy for how to notify us.
We aim to keep Booktime available, but we do not guarantee uninterrupted or error-free service. Streaming requires an internet connection, and its quality depends on your network and device. We may add, change, suspend, or discontinue features — including individual titles — at any time.
To the fullest extent permitted by law, the App and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will meet your requirements or that any particular title will remain available.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of your use of the App. Our total liability for any claim relating to the App is limited to the greater of the amount you paid us in the twelve months before the claim, or ten United States dollars (US$10).
Some jurisdictions do not allow these exclusions; where that is the case, they apply to the maximum extent permitted, and nothing in these Terms limits liability that cannot lawfully be limited.
You may stop using the App at any time and request deletion of your account. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the service. On termination your right to access the catalogue ends immediately; sections that by their nature should survive — including intellectual property, disclaimers, and limitation of liability — continue to apply.
We may update these Terms as the App evolves. We will revise the "last updated" date on this page, and for significant changes we will notify you in the App. Continuing to use Booktime after a change means you accept the revised Terms.
These Terms are governed by the laws of the Republic of Peru, without regard to its conflict-of-law rules, and the courts of Lima, Peru have jurisdiction over any dispute. If you are a consumer, you keep the protection of the mandatory provisions of the law of the country where you reside, and you may bring proceedings in your local courts.
If you are a consumer in Peru, nothing in these Terms limits your rights under the Código de Protección y Defensa del Consumidor (Ley N.° 29571), and you may bring a complaint before INDECOPI.
